Breath samples that show Dr. Christy Natsis of Pembroke had a blood alcohol level more than twice the legal limit have been excluded from the trial.
The judge in the trial ruled that an OPP officer made 'deliberate, systematic and unwarranted' interrruptions to a 40 minute phone call Natsis had with her lawyer.
The judge said her right to legal counsel was breached.
Natsis is charged with impaired driving causing death, driving with a blood alcohol level over the limit and dangerous driving causing the death of Bryan Casey on Highway 17 near Arnprior in March 2011.
Natsis has pleaded not guilty.
The trial is set to resume tomorrow.
