BRIGHTON, Ont. - A 22-year-old man escaped with minor injuries when his all-terrain vehicle got stuck on railway tracks and was hit by a CN freight train east of Brighton, Ont.
Provincial police say it happened at about 4:20 a.m. Wednesday (near Boes Road) near the town east of Oshawa.
They say the man's ATV became stuck on the tracks and he was trying to remove it as the westbound train approached.
The train's engineer saw the vehicle ahead from a distance but was unable to avoid the collision.
Police say the man, who managed to avoid being struck by the train himself, was found in the ditch and was taken to hospital with minor, non-life-threatening injuries.
Nicholas McGrath of Brighton is charged with impaired care and control of a motor vehicle, refusing a breath test and trespassing.
