TRENTON, Ont. - A new court martial has been ordered for a former sailor at CFB Trenton in eastern Ontario who was convicted of sexual assault.

Retired Petty Officer Robert McDougall appealed his conviction after being found guilty at a court martial in late 2007.

McDougall was charged after a fellow student at a training program in Bermuda claimed she was sexually assaulted in her hotel room.

He was sentenced to one year in military prison.

McDougall said they had a consensual sex and appealed his conviction.

A new court martial was granted by the Court Martial Appeal Court of Canada and a trial is scheduled for Oct. 13 at CFB Trenton.

He is not required to stay in custody pending trial.
