The man who killed CJOH sportscaster Brian Smith was found fit to stand trial in a Buffalo, N.Y. courtroom Monday in relation to an alleged assault on a border guard.
Jeffrey Arenburg is accused of assaulting a U.S. border guard Nov. 29 when entering the U.S. on a shopping trip.
When officials checked his background at the Peace Bridge border crossing in Buffalo, they discovered he had a controlled substance conviction in Bridgewater, N.S.
Officials denied him entry, at which point they allege Arenburg became enraged and punched a U.S. border patrol officer in the face.
Today the crown presented a confidential psychologist report stating Arenburg is mentally fit to stand trial.
The Buffalo court judge agreed.
Arenburg remains in custody in the U.S and will be in court on April 3 for a preliminary hearing.
In August 1995, Smith was shot by Arenburg as he walked to his car in the CTV Ottawa parking lot. Smith died the following day in hospital.
After the incident, Arenburg underwent several years of treatment at the Mental Health Centre Penetanguishene in Ontario.
He was released from medical care last year and now resides in Barrie, Ont.
